State Assistance to Persons Disabled since Childhood and Disabled Children in 2010
The Law of Ukraine "On State Social Assistance to Disabled Persons from Childhood and Disabled Children" defines the right to financial support at the expense of the State Budget of Ukraine and social protection of disabled persons from childhood and disabled children by establishing state social assistance as a percentage of the subsistence minimum.
Persons disabled since childhood who are simultaneously entitled to state social assistance in accordance with the above Law, to a pension and to state social assistance in accordance with the Law of Ukraine "On State Social Assistance to Persons Not entitled to Pensions and Disabled Persons" are granted one of the types of assistance or a pension at the choice of the disabled person. In this case, if a disabled person from childhood or a disabled child is entitled to a survivor's pension and state social assistance in accordance with this Law, these payments are granted simultaneously.
State social assistance to disabled persons since childhood, in accordance with the Law of Ukraine "On State Social Assistance to Disabled Persons from Childhood and Disabled Children", is granted for the entire period of disability established by the medical and social expertise authorities. State social assistance is appointed and paid in full by the labor and social protection authorities from the date of application for its appointment.
State social assistance to disabled persons from childhood of group I is granted in the amount of 100 percent of the subsistence minimum for persons who have lost their ability to work. The allowance for the care of a disabled person from childhood of group I is set at 50 percent of the subsistence minimum for persons who have lost their ability to work.
For disabled persons with childhood disabilities of groups II and III, the amount of this benefit is 80 and 60% of the subsistence minimum for persons who have lost their ability to work.
Single disabled persons from childhood of groups II and III, who, according to the conclusion of the MSEC, need constant third-party care, are provided with a supplement to state social assistance for their care in the amount of 15% of the subsistence minimum for persons who have lost their ability to work.
State social assistance for disabled children under the age of 18 is granted in the amount of 70 percent of the subsistence minimum for persons who have lost their ability to work. In addition, a care allowance may be granted to disabled children.
The allowance for the care of a disabled child under the age of 6 and from 6 to 18 years is 50 percent of the subsistence minimum for children of the corresponding age and is granted to one of the parents, adoptive parents, guardian, or custodian who is not working and actually caring for the disabled child. This allowance is granted without taking into account the average monthly total income of the family in which the disabled child is raised.
Persons with disabilities since childhood who are fully supported by the state receive 25% of the amount of state social assistance. The remaining amount (at their request or at the request of their legal representative) is transferred to the institution (facility) where the disabled person has been living since childhood to improve the living conditions of the disabled person in the institution (facility).
For children with disabilities who are fully state-supported, state social assistance is paid in the amount of 50% of the amount assigned and transferred to their personal bank accounts. The other 50% is transferred to the account of the institution (facility) at the child's place of residence. For orphaned disabled children, state social assistance is paid in full and transferred to their personal bank accounts for the period of full state support.
In 2010, the amount of state social assistance to disabled persons since childhood and disabled children is based on the subsistence minimums for persons who have lost their ability to work and children of the corresponding age, as provided for in Article 54 of the Law of Ukraine "On the State Budget of Ukraine for 2010".
Thus, the amount of state social assistance (taking into account the provisions of the Cabinet of Ministers of Ukraine Resolution No. 265 "Some issues of pension provision of citizens" dated 26.03.08) from 01.05.10 is:
- for the disabled since childhood of group I - 1059 UAH.;
- for disabled persons from childhood of groups II and III - 706 UAH.;
- for disabled persons from childhood of groups II and III with a care allowance - 706 UAH.;
- for children with disabilities (without a care allowance) - 706 UAH.;
- for disabled children under 6 years of age with a care allowance - 877,7 UAH.;
- for disabled children aged 6 to 18 with a care allowance - 952,7 UAH.;
- for disabled children whose disease is related to the Chernobyl disaster from 0 to 18 years old - 741,3 UAH.
- for disabled children whose illness is related to the Chernobyl disaster up to the age of 6 with a care allowance - 1124,8 UAH.
- for disabled children whose illness is related to the Chernobyl disaster from 6 to 18 years of age with a care allowance - 1199,8 UAH.
In May 2010, the state social assistance will be paid in two instalments. In the first period, the state social assistance will be paid in the amount of April, and in the second period, an additional payment for May 2010 will be made.
